Brazil makes anti-dumping sunset review final ruling on Chinese man-made fiber knitted fabrics

On February 17, 2023, the Executive Committee of the Foreign Trade Committee of the Brazilian Ministry of Economy (GECEX) issued Resolution No. 449 of 2023, making the second anti-dumping sunset review final ruling on man-made fiber knitted fabrics (Portuguese: malhas de viscose) originating in China. The final ruling of the review decided to continue to impose anti-dumping duties on the products involved in China for a period of 5 years, with a tax amount of US$3.65/kg. The products involved are circular woven fabrics consisting of artificial yarns or filaments, mainly viscose, whether or not containing elastic filaments (commercially known as Lycra), exceeding 30 cm in width, unbleached, bleached, dyed, printed Or yarn of various colors, any weight. Mercosur tax codes of the products involved in the case are 6004.10.41, 6004.10.42, 6004.10.43, 6004.10.44, 6004.90.40, 6006.41.00, 6006.42.00, 6006.43.00 and 6006.44.00. The resolution takes effect from the date of publication.

On November 4, 2009, Brazil launched an anti-dumping investigation on elastic and non-elastic man-made fiber knitted fabrics originating in China. On April 8, 2011, Brazil made an affirmative final ruling on the anti-dumping case and decided to impose anti-dumping duties of US$4.10/kg on the products involved in the case in China. On April 7, 2016, Brazil launched the first anti-dumping sunset review investigation on elastic and non-elastic man-made fiber knitted fabrics originating in China. On February 17, 2017, the Executive Committee of the Foreign Trade Commission of the Ministry of Economic Affairs of Brazil (GECEX) issued Resolution No. 7 of 2017 in the Official Gazette, making an affirmative final ruling on the anti-dumping sunset review investigation of Chinese man-made fiber knitted fabrics, and decided to continue to impose anti-dumping duty of US$4.10/kg until February 17, 2022. On February 17, 2022, the Brazilian Secretary of Foreign Trade issued notice No. 9 of 2022 in the Federal Government Gazette, saying that in response to the application submitted by the Brazilian Textile and Apparel Industry Association, it initiated the second anti-dumping sunset review investigation against man-made fiber knitted fabrics originating in China.
