Brazil makes final anti-dumping determination on China-made polyester yarn

On August 22, 2022, the Executive Committee of the Foreign Trade Commission of the Ministry of Economic Affairs of Brazil (GECEX) issued Resolution No. 385 of 2022 on polyester yarns (other than sewing thread) not available for retail sale, including synthetic fiber monofilaments of fineness less than 67 decibels, originating in China and India, (Portuguese: fiosde filamentos Sint é ticos texturizados de political é steres (exceto linhas para costurar), n ã o acondicionados para venda a retalho, incluindo os monofilamentos Sint é ticos de t í tulo inferior a 67 decitex), made a final determination of anti-dumping and decided to impose anti-dumping duties on the products involved in China and India for a period of 5 years, as detailed in the attached table. The tax numbers of the products involved are 5402.33.10, 5402.33.20 and 5402.33.90. In view of the public interest in Brazil, the measure was suspended for one year. This resolution shall enter into force as of the date of promulgation.

 

 On March 5, 2021, the Brazilian Secretary of Foreign Trade issued notice No. 18 of 2021 in the Federal Government Gazette, saying that on the application of the Brazilian Association of Man-made and synthetic Fiber products (Associa ã o Brasileira de Produtos de Fibras Artificiais e Sint é ticas (Abrafas)), an anti-dumping investigation was launched into polyester yarns originating in China and India, including synthetic fiber monofilaments with fineness less than 67 decibels, which are not available for retail use (except sewing thread). 

 

On September 30, 2021, the Brazilian Foreign Trade Secretary issued notice No. 64 of 2021 in the Federal Government Gazette, saying that a preliminary anti-dumping ruling had been made on the case, initially ruling that the products involved in the case were dumped and that dumping caused damage to Brazil's domestic industry, but temporary measures would not be taken for the time being.
