final review of AD measures against polyamide-6 (PA6) from the U.S., the EU, Russia and Taiwan region

On January 28, 2021, the Ministry of Commerce of the People's Republic of China (the “MOFCOM”) received the application for final review of the anti-dumping measures submitted by 11 Chinese companies including Fujian Eversun Jinjiang Co., Ltd. and Liheng (Changle) Polyamide Technology Co., Ltd., and two supporting companies including Hangzhou Juheshun New Material Co., Ltd. and Zhejiang Hengyi Polyamide Co., Ltd., representing the polyamide 6 industry in Chinese mainland.

According to Article 48 of the Anti-dumping Regulations of the People's Republic of China, the MOFCOM decides to conduct a final review investigation into the anti-dumping measures imposed on the imported polyamide-6 originated in the United States, the EU, Russia and Taiwan Region as of April 22, 2021. Relevant matters are hereby announced as follows:

In accordance with the relevant provisions of the Anti-dumping Regulations of the People's Republic of China, the MOFCOM reviewed the qualifications of the applicants, the products under investigation, similar domestic products, the imports of the products under investigation during the implementation of the anti-dumping measures, the possibility of continuity or reoccurrence of dumping, the possibility of continuity or reoccurrence of damages or related evidence. Current evidence shows that the applicants meet the provisions specified in Article 11, Article 13 and Article 17 of the Anti-dumping Regulations of the People's Republic of China on industry and industry representativeness, and therefore, they are eligible to apply on behalf of Chinese polyamide-6 industry. The investigation authority believes that the applicants' claims and the prima facie evidence submitted are in conformity with the requirements for a final review.

As suggested by the MOFCOM and decided by the Customs Tariff Commission of the State Council, during the final review investigation of the anti-dumping measures, the import of Polyamide-6 originated in the United States, the EU, Russia and Taiwan Region will still be subject to anti-dumping duties at the scope and rate as released in the MOFCOM Announcement No.15 of 2010 and the MOFCOM Announcement No.34 of 2017.

China's AD measures on imports of Polyamide-6

On April 21, 2010, the Ministry of Commerce of the People's Republic of China (the “MOFCOM”) issued Announcement No.15 of 2010, deciding to levy anti-dumping duties against imports of Polyamide-6 granula (the "PA6") originated in the United States, the EU, Russia and Taiwan Region.

On April 21, 2016, the Ministry of Commerce issued Announcement No.4 of 2016, deciding to maintain the foregoing anti-dumping measures for five years.

On July 20, 2017, the Ministry of Commerce issued Announcement No.34 of 2017, deciding to adjust the anti-dumping duties against imports of Polyamide-6 originated in LANXESS Deutschland GmbH and LANXESS N.V. from 23.9% to 8.2%.

Review Investigation Period

The dumping investigation period of this review is from October 1, 2019 to September 30, 2020, and the industrial damage investigation period is from January 1, 2016 to September 30, 2020.

Investigation Period

This investigation starts on April 22, 2021, and usually ends prior to April 21, 2022.
